Costa se desempe\u00f1a como administrativa de Daflex S.R.L, empresa dedicada al rubro textil, desde hace cuatro a\u00f1os. <\/h6>\n<h6>En virtud de que al ser una empresa peque\u00f1a y familiar no cuenta con posibilidades de mejorar en la estructura empresarial ni en sus ingresos, ha decidido cambiar de trabajo. <\/h6>\n<h6>Hoy casualmente la encargada de Daflex S.R.L. se entera en una reuni\u00f3n familiar que Luana ha presentado un curr\u00edculum ante una empresa tambi\u00e9n textil, propiedad de un conocido suyo. <\/h6>\n<h6>Molesta ante la circunstancia de que Luana nunca comunic\u00f3 a la empresa su intenci\u00f3n de cambiar de trabajo, le consulta a usted que sanci\u00f3n puede aplicarle, sobre todo en virtud de que se postul\u00f3 a una empresa que es competencia de Daflex S.R.L.\u00a0<\/h6>\n<h6>\u00a0 2)<\/h6>\n<h6>Fernanda Da Costa, prima de Luana se desempe\u00f1a tambi\u00e9n como administrativa de Daflex S.R.L. <\/h6>\n<h6>En vistas a que su prima Luana ha decidido buscar otro trabajo, la encargada de personal le consulta si ella tambi\u00e9n piensa dejar la empresa, a lo cual Fernanda la comunica que no tiene ninguna intenci\u00f3n de cambiar de trabajo. <\/h6>\n<h6>Una semana m\u00e1s tarde la encargada encuentra entre los documentos con los que trabaja Fernanda un curr\u00edculum destinado a un estudio contable al cual aspira ingresar. <\/h6>\n<h6>Ante \u00e9sta situaci\u00f3n, la encargada le consulta a usted que sanci\u00f3n le puede imponer por \u00e9sta situaci\u00f3n.<\/h6>\n<h6>3) <\/h6>\n<h6>Fernanda Da Costa preocupada por la situaci\u00f3n de rispidez con su encargada, le consulta a usted que habr\u00eda pasado en el supuesto caso de que hubiera, tal como ten\u00eda pensando, imprimir en la empresa unos veinte curr\u00edculums que ten\u00eda planificado enviar a distintos estudios contables, utilizando papel e impresoras de Daflex S.R.L.<\/h6>\n<h6>4) <\/h6>\n<h6>Macarena Vaz, abogada que, de manera independiente, y en su estudio, asesora y patrocina en asuntos laborales a Daflex S.R.L, debi\u00f3 presentarse en el d\u00eda de ayer a las 12:30 horas a una audiencia ante el Ministerio de Trabajo, no asistiendo a la misma por un error de anotaci\u00f3n de horarios en su agenda. <\/h6>\n<h6>Uno de los socios de Daflex S.R.L. le consulta que tipo de sanci\u00f3n se puede aplicar a la abogada.<\/h6>\n<h6>\u00a0<\/h6>\n<h6>5) <\/h6>\n<h6>La hermana de la dra. Macarena Vaz trabaja como administrativa de un sindicato, quien entiende que no se le han abonado las horas extras conforme a derecho, por lo cual ha decidido reclamar ante el Ministerio de Trabajo, y eventualmente ante la Justicia Laboral al sindicato por las horas extras impagas. <\/h6>\n<h6>Conversando con usted le consulta si es posible que se entable un reclamo laboral contra un sindicato, y si es posible que luego el sindicato aplique alg\u00fan tipo de sanci\u00f3n en su contra por el reclamo.<\/h6>\n<h6>6) <br \/><\/h6>\n<h6>La encargada de Daflex S.R.L. solicit\u00f3 a Luana Da Costa que en el d\u00eda de ayer se quedara en su puesto un par de horas fuera de su horario habitual, para solucionar unos problemas contables generados presumiblemente por error de Luana. <\/h6>\n<h6>Aunque entiende que el problema puede haberse ocasionado por su causa, Luana se niega a quedarse fuera de horario ya que tiene planificado ir al cine con unas amigas. <\/h6>\n<h6>Al d\u00eda siguiente la encargada niega el acceso a su puesto de trabajo a Luana Da Costa, comunic\u00e1ndole que debe firmar el Libro de Registro Laboral notific\u00e1ndose de encontrarse suspendida por dos d\u00edas, como sanci\u00f3n a su negativa del d\u00eda anterior a la solicitud de hacer horas extras. <\/h6>\n<h6>La encargada le solicita que redacte usted la sanci\u00f3n.<\/h6>\n<h6>7)<\/h6>\n<h6>Realizando un mantenimiento general de las computadoras de Daflex S.R.L, Lucio Daer, socio de Daflex S.R.L. encuentra en el historial de la computadora de la encargada de personal acceso habitual a sus redes sociales, y a diferentes juegos en l\u00ednea. <\/h6>\n<h6>Con la finalidad de sancionar a la encargada, Lucio decide apercibirla, solicit\u00e1ndole a usted que redacte el apercibimiento que deber\u00e1 constar en el Libro de Registro Laboral, y le consulta que se podr\u00eda hacer en caso de que la encargada se resista a firmar el apercibimiento.<\/h6>\n<h6>8)<\/h6>\n<h6>Una nueva agrupaci\u00f3n pol\u00edtica independiente, denominada Movimiento Democr\u00e1tico Oriental, ha contratado a la dra. Macarena Vaz para que en relaci\u00f3n de dependencia se encargue de todos los aspectos administrativos de la agrupaci\u00f3n. <\/h6>\n<h6>Unos meses despu\u00e9s, uno de los l\u00edderes de la agrupaci\u00f3n toma conocimiento de que Macarena a trav\u00e9s de sus redes sociales realiza comentarios contrarios a la agrupaci\u00f3n, dando a conocer algunos asuntos de la vida particular de los l\u00edderes del nuevo partido, y expresando en reiteradas ocasiones que su v\u00ednculo con la agrupaci\u00f3n es meramente laboral, ya que adhiere como votante a otra agrupaci\u00f3n pol\u00edtica ya establecida. <\/h6>\n<h6>Le consulta dicha agrupaci\u00f3n a usted que sanciones se podr\u00edan aplicar a la funcionaria.<\/h6>\n<h6>9)<\/h6>\n<h6>El reglamento interno para los empleados del Movimiento Democr\u00e1tico Oriental indica en su art\u00edculo 4 que los trabajadores que se afilien al sindicato ser\u00e1n intimados por escrito a desafiliarse del mismo en un plazo de 48 horas, y en caso de no hacerlo ser\u00e1n suspendidos dos d\u00edas la primera vez, duplic\u00e1ndose la cantidad de d\u00edas de suspensi\u00f3n en las sucesivas intimaciones a desafiliarse que fueran incumplidas.\u00a0 <\/h6>\n<h6>Habiendo firmado el Reglamento todos los empleados, uno de los l\u00edderes de la agrupaci\u00f3n le consulta si dado el caso las sanciones pueden aplicarse de esa
